Defendants Motion Moving The Court To Refer Criminal Charges
For Prosecution

Comes Now, Sean Riker, pro se Defendant, moving this court to refer criminal charges for the child pornography that the states star witness downloaded, possessed and viewed:

FACTS

In 2009 & 2010, while Riker sat in the Racine county jail fighting the false allegations in this case, the states star witness downloaded child pornography onto his home computer and laptop computer and called the Racine sheriff's and falsely claimed Riker did the downloading.

A forensic examination was performed on both computers and it was determined ALL of the child pornography was downloaded while Riker sat in the county jail and some if it was downloaded (18) minutes before the states star witness, T.A.R. nee T.A.J. aka T.A.M. of Fort Collins, Colorado called to falsely report Riker did the downloading. The state did not charge their star witness with filing a false police report OR for possessing and viewing child pornography. It was swept under the rug as if it didn't happen because it would have destroyed the states false allegations against Riker in this case.

On July 28th, 2023 Riker had a brief hearing in this court. Riker filed two motions, One to obtain the juror questionnaire of a particular juror Riker thought committed felonies prior to Rikers trail and Two to have Rikers computers in questions returned to him, sans the child pornography, because those computers contain family videos, family pictures and emails that exonerate Riker.

The juror Riker thought committed felonies turned out to be the wrong person with a similar name and the judge denied that motion.

The computers in question and the return of them to Riker was also denied based off of the states star witnesses child pornography on them.

However, for the first time ever, the state/judge conceded that.."it is my understanding that the contraband on the computers was downloaded while you were incarcerated..." or words to that effect and the judge went on to say the computers would not be returned to Riker for numerous reasons along the lines of, child pornography on them, potential criminal charges, the computers being evidence, etc...

HURDLE'S FOR RIKER

Wrongful Conviction & the Impact of Corruption:
(a) Sheriff Corruption:
Allegations of evidence of corruption within the sheriff's dept.
Influence on the investigation and trial proceedings.
Subversion of justice and violations of ethical standards.

(SWEEPING CHILD PORNOGRAPHY UNDER THE RUG IS CORRUPTION)

(b) District Attorney Corruption:
Role of district attorney.
Prosecutorial misconduct and unethical practices.
Implications for the fairness of the trial.

(RICHARD CHIAPETE AND PATRICIA HANSON ENTERED THE RACE TO BE ELECTED RACINE DISTRICT ATTORNEY. CHIAPETE WON THE ELECTION, WENT ON TO COMMIT NUMEROUS FELONIES, STEPPED DOWN AS RACINE DA, PATRICIA HANSON SELF APPOINTS HERSELF RACINE DA, DROPS THE CHARGES AGAINST CHIAPETE AND IS STILL A RACINE PROSECUTOR... SWEEPING CHILD PORNOGRAPHY UNDER THE RUG THAT THEIR STAR WITNESS DOWNLOADED BECAUSE IT'D RUIN THEIR CASE AGAINST RIKER...IS THE PUREST FORMS OF CORRUPTION. THESE TWO EXAMPLES EPITOMISES THE WORD CORRUPTION.)

(c) Judicial Reluctance to Address Corruption:
Challenges in proving corruption.
Lack of accountability for corrupt officials.
Implications for the erosion of public trust in the judicial syst.

CONCLUSION

There is no question that child pornography is on the computers in question and that it was downloaded while Riker sat in the county jail in Racine and that the computers hard-drives are better than DNA or fingerprints. So why wouldn't child pornography charges be made unless corruption in Racine is a real thing? At the very least, why wouldn't the child pornography be referred to the Federal Government, which is REQUIRED by law, for criminal charges unless corruption exists in Racine?

For the reasons states herein, Riker moves this court to do the right thing and refer criminal charges and an investigation as to why it wasn't done sooner.
