I'm grieving the response that M.A. Davis gave on a request slip that I sent him on 3/12/14 where he responds on 3/18/14 and I quote, "There is no reason at this time to reconsider your release from D.C. status. You received 23 days for a fight D.R. running consecutive to a D.R. for mail violation 23 days beginning 3-7-14, you have D.C. time left to be served" In quote. The fact is the ICT is clearly not following 33-602.222(8)(a) "A member of the ICT shall review the cases of inmates in disciplinary confinement every week. The goal shall be toward returning an inmate to open population as soon as the facts of the case indicate that this can be done safely" In quote. So the issue that Mr. Davis addressed stating you have D.C. time left to serve, shows that his goal is not to return me to my living quarters as soon as safely possible, but instead is to see that I serve the most amount of D.C. time as possible. Which goes against the rules as they are indicated.

Fact DR #213-140286 was a self defense fight that was beyond my control. I was being attacked I had to protect myself.

Fact DR #213-140287 was for a 15 year old web site that I requested to be taken down but it no longer has an owner/operator. For it's been brought to my attention she passed away. So I have no control over www.angelfire.com and haven't since 2004.

Based on these facts there's no reason why I cannot be returned to a normal (open population) death row cell at this time. For doing so would not pose an additional security threat, nor further disruption of the orderly operation of this institution and would not result in further incidence regarding these infractions.

Disciplinary time is a tool for modification of your UNSATISFACTORY behavior and as it states to discipline you for a infraction of department rules. The ICT does review your case weekly and your continued DIC status is appropriate at this time. You have no inherited right for a early release from DIC status. We will continue to review your DIC status and release at the appropriate time.

Based on the above information, your grievance is: Denied.
