Hi everyone. The prison is on lockdown. I haven't received any response comments in the mail lately so if you sent them, I didn't get 'em. I say this because people have told me that they respond but I never got them. So again, I always respond to whatever a person writes to me. If you're that interested in talking to me, write me a letter. I'd kinda prefer it, but if you do, I need an address to respond to. Policy is all incoming mail must have a full name & return address or it will not be given to me. I am waiting to hear from Julie (Eagle Spirit 96), Meagan Brown, & I am wondering where my "Canadian Comrade" is. I could really use your help.

Okay, this is my problem. My PCRA appeal was just denied. I attempted to argue that I was only 21 at the time of my crime; I should've been treated the 17 year olds. The science says that our brains are not fully developed until age 25. But here, the legal age of an adult was made up over 100 years ago before anyone knew of any of this stuff. But the US Supreme Court used this same science to change the law & state you cannot give a juvenile a sentence of life in prison or death. In Illinois, they are changing the laws so that you are still a juvenile until age 21. A woman who referred to herself as my Canadian Comrade, she offered her assistance in research & if you're reading this, I could really use your help. Please get in touch with me.

But what I'm doing now is my trial attorney, David Francis Luvara, he was a horrible lawyer. I won't go into how inexperienced he was & how he lied to my family & the courts in order to be qualified to be my lawyer. In a death penalty case, a lawyer must have a specific amount of experience in this past to qualify. My lawyer lied about his. But a month before my trial, my lawyer was in Philadelphia committing crimes for another client of his. My lawyer was convincing witnesses in this case to change their testimony, to lie on the stand & he was eventually charged with bribery, tampering with witnesses, & a list of other crimes.

So this is my argument now. He was out there committing crimes for another client so he was not fully invested in defending me. I am not a lawyer, I am qualified to argue this, so hopefully I can convince a judge, with my limited knowledge of the law, to give me a lawyer & allow a trained professional argue this. The legal system truly is designed against us in prison. Lawyers have years & years of schooling to be trained & educated for this, but us: we have a month, sometimes 60 days to get an appeal done. I know of 1 person who I truly do believe is innocent but he ran out of time to file an appeal, so he is stuck with a life sentence.

For example, my appeal lawyer forgot to file my appeal in 2001. So since he forgot to do it in the 30 days that he had, I was time barred. So that means that no matter what, my appeals are done. even if I was innocent of my crime, I cannot appeal it because a trained professional forgot to file an appeal in the time allowed. Only way to overcome that is if I could prove with DNA evidence that I was innocent or if a new came out that affected me. A lot of prisoners try to get back into court on a "newly discovered evidence" argument & sometimes they are successful. This is what I am trying now.

But once you find out about the new evidence, you have 60 days to file an appeal or you cannot file one. So i'm asking for a court appointed lawyer. I would gladly take a public defender.

Enough of the law. We are getting puppy dogs in this prison soon & I for one am super excited. I can't get one because I have a "Z-Code". That means I cannot have a cellmate. But I love animals. I love dogs & I can't wait to play with a little energetic puppy. After their training, these dogs would be sent out to a specialized center & given to wounded warriors, guide dogs, PTSD dogs, hearing impaired. I could never live with another man in the cell, but I could live with a dog. The cells are 8'x6'. Not much room for anything.

Pell Grants have recently been reinstated. We're not sure yet if life sentenced prisoners can participate in this. In the mid 1990s, Pell Grants were taken away from prisoners. A Pell Grant allows a prisoner to go to school for free. Society complained that prisoners were getting a free education while they have to pay for their kids to go to school. I understand that, but would you want a prisoner to do 10 years, come out a worse person than he was when he went in? Or would you want him to have an education, a job skill? I go with option #2. We get paid 19¢ an hour to work. No way we could afford to pay for our own schooling. I know a lot about working out, nutrition, various exercises. I'd like to get an education on that subject so I can possibly write a book on it.

My best friend Aaron is getting married this weekend, 3 days from now. I wish him & his beautiful bride to be, Tara, a great life together. Tara is also pregnant with babay Isabella, due in October. I can't wait to see photos of this little one.

As life goes on in here, it continues to get harder & harder. If anyone is willing to help me out in any type of way, please let me know. I've never liked asking for help, but we all can't do it alone. If you want to keep it private, write me a letter. Give me a name & address to respond to. As I was reading cases on attorney legal ethics, I came across one. Last name was Cappuccio. He was an Assistant Director Attorney in Bucks County. He was the guy who prosecuted criminals, sent them to prisons for decades, but then when you read his case... He was a youth group leader for a church. He was having sex with children, giving them drugs & alcohol. Well, in the end, he is given 6 months in county jail & his law license is suspended for 5 years. Then he can go back to being a lawyer. The Bucks County District Attorney's Office really took care of their own in that case.

I want to do better in life, I want to be better. Not just for me but for the people who are in my life. I owe them so much. But that's all for now. Lunch time.
