True equality does not exist in the United States Judicial system. We see the disparity all the time between the rich and the poor in the news and on the front page of our local news papers. Where rich well off defendant's are represented by top notch law firms. Law firms that have the resources and financial means to go toe to toe with the District Attorneys office. Whereas your average law firm, and Public Defenders office that's set up to represent the poor and underprivileged, has a financial budget that they must stay under. You have to be deaf, dumb and blind to see that true equality does not exist in our US legal system.
Here on death row, you'll see some of the worst examples of equality and piss poor representation than you'll ever see anywhere else. In March 2005 then Florida Supreme Court Justice Raoul G. Cantero III. criticized these state appointed lawyers that was appointed to fight for our lives, saying, "This is some of the worst lawyering I have ever seen." Although he admitted to it, he took no action or stance to correct it. Although this poor lawyering as he calls it, was putting men and women's life at great risk. I had several of these incompetent lawyers. One Dale G. Wrestling Jr. turned over my entire attorney files, attorney notes Doctor reports ect to the State attorneys office violating attorney client confidentiality. And I'be got an email for which I attached to motion of objection, where Assistant Attorney General Meredith Carboula admits to having in her possession files that she's not entitled to. That would have never been permitted to take place to a wealth client. But because I was poor white uneducated trash, there was no harm no foul. Which supports my argument of a justice system that's flawed with bias treatment. From jump street, Judge David C. Wiggins appoints me a lawyer under conflict free counsel, who's never handled a capital care. And shouldn't have handled mine. I'm a 21 year old stupid juvenile ass kid. Who's never grown up or had any responsibility. I had the mentality of maybe a 15 year old. My mind was not only not fully developed but probably underdeveloped as a result of drugs and alcohol. So here I am facing first degree murder for the shooting death of a 38 year old white male, when they appoint me this attorney Henry E. Davis, who's so incompetent that he doesn't hire an investigator or ask the court for co counsel. They the State attorney and Judge had their minds made up. I was going to plead out to a mandatory 25 years. But because I was hardheaded, and refused they slight the death penalty. I've got a document showing where the prosecutor called my attorney and said I had until September 27,1990 to take the deal or they would seek the death penalty. They tried all the way up until the trail date to get me to take the deal and I refused. Two reasons, one my codefendant was getting a lesser sentence of 25 years for which he served 11 years 2 months on. And he was saying I shot the man, I was saying he shot the man. He was far more culpable than I was. He stole the gun from a ladies house that he was working for. He shot the man for the truck. And then tried to sell the truck the next day, to a guy he knew named Joseph Strickland. Which is in the records. A high powered attorney would have torn these state witnesses apart. For you look at their depositions and sworn statement's and you can see that they are being instructed to lie. My incompetent state paid lawyer doesn't even cross examine several people, and when he does its pathetic. Equality was clearly absent! It was lost somewhere under the scales of justice that was laying in the trash can with the rest of my constitutional rights. For is it not written that you have a constitutional right to a trial by a jury of your peers? Well if that's the case, then why, when I opted for this right, was the state able to threaten my life? They didn't think it was the worst of the worst a case deserving of death, until I refused to take their deal. Then and only then did they want my life. Again they would not have done that to a rich man. Yes...that's the difference between the rich and the poor. The rich have the money to protect their constitutional rights, whereas the poor doesn't. Had I taken the states offer 30 years ago this month. I would have been out on the street five years ago. But because I didn't I sit here in this cage under the sentence of death. Yes equality is a pipe dream and a facade here in America. I'll be writing more on this subject in the near future. For these are issues that need to be brought to light.
