Informal Grievance filed to the Warden on Monday May 9, 2022

I'm grieving the fact that your not complying with United States District Judge Marcia Morales Howard's Court Order, issued on April 28, 2022 where on page 27 of her 30 page Order she states," The Joint Motion for Final Approval of Class Action Settlement and Memorandum of Law in Support Thereof (Doc 113) is GRANTED." On page 29 of her Order issue 7. states." As to the Class Members, the Final Settlement Agreement is MODIFIED as follows: a. The Implementation Deadline set forth in paragraph 24 of the Agreement is extended to May 9, 2022. Failure to implement the agreed-upon improvements to the conditions of confinement on Death Row by this date will constitute a breach of the Agreement." End quote. Now FDOC counsel in this JOINT MOTION FOR FINAL APPROVAL OF CLASS ACTION SETTLEMENT AND MEMORANDUM OF LAW IN SUPPORT THEREOF," Doc 113, filed 11/12/21 on page 16, lines 13-17 agreed on the following, "The Settlement mandates that, irrespective of COST or STAFFING ISSUES or anything else, the FDC must provide the day rooms, out-of-cell time, and all other relief. If the FDC does not meet these obligations or fails to comply in any way, Plaintiffs can and will enforce the Settlement pursuant to its terms." End quote. This administration was fully aware of this, and had six months to put this together. You've violated the Order here on day one. And staff has stated that we get two hours ever six working days. This is non compliance with the Order. Wherefore I'm calling for full compliance of this Joint Motion for Final Approval of Class Action Settlement and Memorandum of Law in Support Thereof and Judge Howard's Order. I'm entitled to a minimum of three hours a day room five days a week, showers, phone and kiosk access. Thank you for honoring this agreed upon Court Order.

THE FDOC AND IT'S DISRESPECT FOR FEDERAL JUDGE MARCIA MORALES HOWARD.

You know the stupidity of the Florida Department of Corrections ceases to amaze me. They're just straight out disrespecting Judge Marcia Morales Howard, who just issued an Order on April 28, 2022 agreeing with FDOC counsel, and our counsel who in November 2021 jointly filed this Motion titled "JOINT MOTION FOR FINAL APPROVAL OF CLASS ACTION SETTLEMENT AND MEMORANDUM OF LAW IN SUPPORT THEREOF," Court Document 113, filed 11/12/21 where on page 16, lines 13-17 they agreed on the following, "The Settlement mandates that irrespective of cost or staffing issues or anything else, the FDC must provide the day rooms, out-of-cell time, and all other relief. If the FDC does not meet these obligations or fails to comply in any way, Plaintiffs can and will enforce the Settlement pursuant to its terms." End quote. Now here we are six months later. Judge Howard issues her Order for full compliance to start on Monday May 9, 2022. Well its no big surprise that UCI and the FDOC has a history of not really giving a damn what a Federal Judge says. And especially if that Judge is a woman. This place wasn't named the Florida Department of CORRUPTION for nothing. Here it is on day one of her Order, and they breech it. And it'll be breeched for several weeks and probably even months.

But this place has always had the sick, twisted mentality that they are above and beyond the law. Always has been, always will be. This is the good old boy dirty south! Big deal if she fines them. They'll play the measly $25,000 to $50,000 fines with the tax payers' money, and keep doing what they do. Yes, the good old boy way of the Florida Department of Corruption. They've disrespected everything about Judge Marcia Morales Howard!! She told them to have the day rooms up and running by January 1. Well, that came and went, and the FDOC was lollygagging around not taking her serious. So they told her we will have it up and running by mid April. Well April came and went with no big surprise that they still weren't ready. And then here it is at the end of April, and she issues her Order for full compliance on Monday May 9, 2022. And once again the FDOC in its nonchalant way, ignores her giving her the middle finger in their normal disrespectful way of showing these Federal Judges that they never have, and never will take them serious. So the ball's in her court, ironically speaking, let's see if she caves to them, as they believe she will, or if she enforces her Order to full compliance. And if she does, well let's see if the good old boy FDOC tells her where she can put her Order. This place is what it is, and it rightfully earned the title of, "The Florida Department of CORRUPTION".
