I finally found out that my 3rd amended complaint has in fact been received and filed by the San Jose Northern District Court. I wrote about this before because it has been a struggle trying to get my court documents to the courts. On several occasions, the judge dismissed my case because the court didn't receive my documents. The court believed I was intentionally delaying and shirking my responsibility in pursuing the civil rights complaint.

And I had to file all kinds of motions and arguments to convince the judge that I did in fact file them. Each time it takes six to nine months to get the case back on track. And it's now been four years that I've been waiting to resolve it, either by settlement or by jury trial. It makes no difference to me. I know I'm going to win.

But prison officials have been holding my documents and claiming they mailed them. But if they had, the court would have received them. Even if late, they still would have received them. Now, since the main defendant has supposedly died right after I had him served with a court summons, it has set me back again.

The court ordered that I name an executor of representative for the deceased defendant, so I did that and, at the same time, amended the complaint to add another defendant of two. And now I hope that I can have it proceeded through the court.

And last night I finally received confirmation that they in fact filed it. So that was good, and now I just wait for the court to do its job.
