I am not a lawyer, so, legally, I can't advise YOU on how to litigate a case. But, I can tell you what I would do, if I was you. Construe this thusly.
Attached is a copy of the John-Doe Petition (J.D.P.) that was filed by F.F.U.P, the one discussed in the ISTHMUS and then the MILWAUKEE JOURNAL-SENTINEL articles. I corrected some typos, added a sub paragraph and blanked out the name and address for Peg Swan, the lady who filed it for F.F.U.P.
ANYONE can file a J.D.P. You don't have to be a victim of the suspected crime(s) to do so. If you're the relative/friend of a prisoner who fits any of the situations describes in §6 a)-g) of the J.D.P, you are "anyone" and you can file it. Prisoners' J.D.R.s ate routinely (and improperly) dismissed. J.D.P.s filed by persons and especially groups (e.g. a church, WISOM) are taken more seriously because those filers can vote and the judges in WI are elected .
What I would do to file my J.D.P., if I was you, is send the J.D.P. To your prisoner friend/family, ask him to collect trust account statements, copied of complaints, etc. that reveal prison officials are illegally taking his and his associates' money (as noted in §6 a)-g) of the J.D.P., have him mail those documents to you with affidavits from him and the others stating the FACTS (not arguments, opinions or thoughts) that confirm money was/is illegally taken. You then add this to §7 of the J.D.P., in the same for, that I gave examples of prisoners I know who've had money illegally taken - you can leave the examples of mine in §7, or replace them with you own. Either' fine.
