Current Offense/Field Supervision Violations

97CF140 LaCrosse County 1st Deg Intentional Homicide (PTAC), Arson of Building, Damage to Property by Explosives (PTAC), Burglary (PTAC). Details of his offense include entering a residence with his brother, killing the victim by striking them in the head twice with a wrench, setting fire to the residence, stealing money, fleeing and two counts of escape from a county jail. [The "escapes" were in 1994 - I left work release + didn't come back for several days the 1st time + several months the last]

02CF85 Grant County Battery by Prisoners charges included inmate not complying with orders from officers. When cell entry was initiated, inmate became combative, resulting in injuries to two staff members. [I kicked one guard + was accused of "scratching" a 2nd, through his stab-resistant vest. Weirdly, I was charged + convicted of the never-happened scratch, not the kick.]

Adjustment Comments
Mr. Lindell arrived at WSPF from WCI on 2/28/01, based on a pattern of behavior that included receiving CRs for such offenses as Threats and Fighting.
These are two of the conduct reports he received since last classification.

6/11/12 360 DS .45- During a search of Mr. Lindell's cell, 2 pieces of eyeglass bows were found which were fashioned into weapons.

10/8/12 .12 360 Program 30 RC Restitution- During medication pass, Mr Lindell noted, "I have a library book for you." Mr. Lindell then reached over in the direction of the shelf. He then put his hand out of the trap with a milk carton full of brownish-yellow liquid, which he threw on the officer. The liquid hit the officer in the face.

It should be noted that Mr. Lindell has participated in the HROP program at WSPF, and has participated in an Anger Management program.

Inmate Comments
The inmate felt that going to WCI was sprung on him; they came in told him to pack. As he was going out the door the Social Worker said he was leaving and needed to do his PRC. He states he has some things he wants noted. First, in regards to his withdrawal from Anger Management; he felt pressured by the facilitator to quit. The two of them had an ego conflict. It's not that he didn't want to do the program. He's ok with doing Anger Management. Second, he feels he was sent to WSPF on pure BS, no real reason. And then got a flood of crs so then there was a reason. Third, he knows he was self-destructive there for awhile. He went to WRC and some guy try to stab him so he stab him back. He ended up coming back to WSPF and some guy picked a fight with him, he got disciplined for that.

In regards to being at WCI; it's a dump. All the inmates are insane. The staff is decent. He states he does have some concerns about WCI staff that are still there when he was there originally. He's concerned that they framed him once before; they can do it again. In regards to some of those fighting crs, he had to protect himself, he was not the one starting them. He notes is is "pro-white"; but doesn't and has never sought out others because they aren't white to fight or pick at them. He's not about that. He feels he may bring some of this stuff on himself because of his attitude. He could understand that, he states, I guess.

TimeStamp: 11 January 2013 16:03:27 --- User: C. Morrison/WSPF

[Actually, I said I was sent to WSPF based on a frame, which I later overturned in court. I could not fight a flood of conduct reports (C.R.s) though, although I did beat a second one in court too.

At WRC, staff let a black Vice-Lord member, a big guy with zero brains or class, bully, extort + otherwise prey on others, non-black inmates then he fucked up + tried to intimidate me, SAID he was gonna stab me, but didn't have an object in me when he said that. His mistake.

Never said the staff here are decent. Some are. Some are very twisted, otherwise, what she stated above is fairly accurate. She said "Good luck", sounded like she meant it. Problem is that it just takes one hater to sink my ship + there's far more than one guard who wishes me misery, evil + failure. There's a million ways such staff can destroy me + who'd believe a scumbag like me?

What's left is lashing out. That's it! So I do. There's no hope, no fairness, no justice.]

Committee Comments
This is a scheduled review; the inmate appeared for his review. The hearing will address custody, placement and program issues. Case preparation has occurred per s. DOC 302.07 and 302.10. Social Worker comments, recommendation, including offense details are noted and reviewed by the Committee. Inmate is currently OWO at WCI; he being reviewed via telephone. Inmate was to be reviewed in 12/2012; however due to conduct issues and subsequent transfer/OWO to WCI, review is being held today.

Inmate's admit date is 3/3/98, he has served 14 years, 10 months. He arrived at WSPF on 2/28/01 from WCI. He is currently max custody. He is 37 years old; serving his 1st incarceration. Currently serving a life sentence. Inmate has an initial parole eligibility date of 3/3/2048.

He has a total of 21 minors, 46 major conduct reports. The inmate's Social Worker notes his most recent major cr in the Adjustment section. The inmate's risk rating is overall high due to sentence structure; institution adjustment, DSEP status while at WSPF; and temp factors, pending case in Grant County. He is moderate in emotional/mental health, MH-1; and program participation, withdraw from Anger Management. He is he low in escape history; however, escape type behaviors are noted in 1994.

Programs are identified above. Additional program information may be noted by the inmate's Social Worker and is also in the Program Information section.

Per SS. DOC 302.07 and 302.09, and based on the above, the Committee unanimously recommends continued maximum custody and transfer to WCI. The inmate's ongoing conduct issues, noting staff assaults and continued unacceptable behavior, have resulted in the need to transfer inmate Lindell to WCI. Inmate Lindell has been at WSPF/WSPG since 02/2001; with an approximate two month stay at WRC from 05/2002 until 07/2002 when he returned to WSPF. The Committee agrees continued maximum custody is suitable as is placement at WCI. The Committee also took into consideration when making this recommendation the inmate's offenses; noting loss of life, severity and nature of offense, offense history which dates back to 1993; violation which led to a new sentence, legal issues, clinical needs, premature time-frame for treatment needs, escape history, first incarceration and time served. Recall is set for 12/2013. This decision is based on the above and factors identified in DOC 302.07. Inmate was advised of Administrative Review rights.

So, yep. I was kicked outta WI's supermax. :) The haters here DON'T like that. Too bad. You know this will lead to a future conflict. Who knows what it'll be.

Right now they're trying to make me dispose of extra photos, publications + legal papers (some for a pending suit against WDO staff) without allowing me to choose which ones I keep + which ones I dispose of. Appreciate it if ya call the warden, Pollard, at 920-324-5571 or fax him at 920-324-7250 + protest this. C.O. II Levey is the guy who absolutely refuses to let me decide what I keep + what I dispose of.

Love + respects y'all :)

Nate
