I finally heard from the federal district court, northern district. Turns out the court never received my amended complaint that I had mailed out in September 10, 2013. This is the third time the court has told me this, and twice before had dismissed my civil rights complaint which I filed in 2010.
I've had nothing but problems with the mailing of documents and receiving court documents. Twice I had to argue my way back into the courts to ask the court to reconsider its dismissals. I was lucky that I had copies of most of what I mailed and could show the courts that I had in fact sent my documents.
At first, I began to accuse the district court clerks because the prison has a logbook that logs all legal mail. But this has been happening so often, I have to ask myself why the court would throw away my documents. What reason would they have? They don't know me. The lawsuit isn't about them, so why would they be interfering with my case? They would have no reason to.
But the prison, on the other hand, has a lot of reasons. Prison staff lie for each other. They file false reports. They've confiscated my legal materials before. They've lost materials, and the civil suit is against a prison guard. So they can log my mail that it was mailed, but that doesn't mean it was actually mailed. They cover themselves with the log and sabotage my court action at the same time. They already seen how much trouble it took for me to get my case reactivated.
