AN INNOCENT QUEST FOR JUSTICE

Logic would dictate a legal system that prides itself on protecting the integrity of the law would not hesitate to correct a miscarriage of justice when evidence is revealed to show an innocent person has been falsely convicted of a crime they did not commit. Which makes protecting the integrity of the law even more important when an innocent person is falsely convicted of murder and sentenced to death. Since logic would also dictate no one wants to execute an innocent person when evidence comes to light proving the innocent person did not receive a fair and impartial trial.

One of the most compelling pieces of evidence that comes to light to prove an innocent person did not receive a fair and impartial trial is when the prosecuiting attorney withholds favorable evidence that disputes the evidence of guilt being presented against the innocent person at trial. Since the integrity of the law states a person on trial is to be presumed innocent until proven guilty beyond a reasonable doubt. This means the prosecuting attorney has the burden of proving guilt beyond a reasonable doubt. So when evidence comes to light the prosecuting attorney withheld favorable evidence which disputes the evidence presented at trial in order to obtain a conviction. The person falsely convicted by this grievous misconduct by the prosecuting attorney has to be awarded at the very least a new trial. For in effect what the prosecuting attorneys misconduct has done is to shift the burden of proving guilt beyond a reasonable doubt to the innocent person having to prove the integrity of the law was violated due to the withholding of favorable evidence

Which can only take place after the innocent person has been falsely convicted, and discovers the prosecution misconduct or withholding favorable evidence so it can be argued on appeal. Which in itself is no guarantee the interigrity of the law will not continue to be violated as the prospect of an innocent person suffering miscarrige after miscarriage of justice to the possible end of an innocent being executed does exist ...

I am an innocent victim of this vicious cycle having continued now for over thirty-one years, and know the carousel of injustice I suffer will not end well for me unless the court of public opinion intervenes to protect the integrity of the law.
