THE GAMES CONTINUE

I've already made a number of posts regarding my lawsuit, but for
—of you who haven't read them, it all comes down to this.

I was told b—
Primary Care Physician (PCP) that I would be receiving some new medica—
but at the time, he was unable to provide me with a name as he wasn't—
what would be authorized. The next day, and every 30 days, for the—
90 days, the prison pharmacy issued me a 30 day supply, which I was too—
instructed. What I didn't know at the time, what I had no way of kn—
because we aren't provided with this information, was that the medic—
contained an ingredient I was allergic to, an ingredient that the p—
pharmacy knew me to be allergic to, one that resulted in my sufferi—
permanent physical disability, and one for which I'm currently suing the—
now in an attempt to receive my surgery my doctor, and the experts ret—
by the prison, all agree that I need to correct the problem.

I filed my suit in April of this year. Shortly thereafter, a—
deposit, well over twice what I was legally required to pay, was sent to—
and they mailed me a receipt, along with a copy of the money order t—
received. Since that time, I've made all of my monthly payments, and I—
the receipts provided to me by the prison, the party who deducts this—
from my account, but in both cases, the local court clerk is insisting
they haven't received a single payment, despite my having receipts, at le—
of which is from them, stating otherwise.

I've mailed in letter after letter complaining about this, and alt—
each is reasoned to, that particular issue has never once been address—
them. Instead, when I attempt to file a motion, they return it to me,—
with a form letter with a box checked, stating that I haven't mad—
payments.

Now, the prison has become involved. I had a court appearance sched—
for the 21st, and I did everything in my power to notify of them of this. —
response was that I needed to contact a company called Court Call, so I d—
sent them all the information they needed, and their response to me was a—
letter asking me for the exact same information. On the day I received —
letter, I also received a letter from the court, stating that the hearing
had been moved to the 25th of August, so in my response to Court Cal—
provided them with this new information, along with copies of all of the—
documents I had regarding the fee waiver (with the exception of the— fee),
the parties involved, the court date, etc. A little more than a—
later, I walked into my cell to discover that the prison hadn't maile—
letter out. Instead, they'd simply held onto it for a while and then deliv—
it to me.

We're told that taking the law into your own hands is wrong, and I—
disagree with this, but how in the world is a person supposed to do the—
thing when each and every avenue available to him is intentionally block—
the very people who are responsible for keeping them?

The clerk'— intentionally lying about what they have or haven't received, and th—
refusing to accept anything I've tried to file. As I understand things,—
is actually illegal, as they're supposed to file anything I've sent to—
regardless of my financial situation. And now, the prison is playing
with my mail. As if this wasn't bad enough, they're also doing everythi—
their power to ignore the fact that I've got an upcoming court appearance—

On Monday, first thing in the morning, I'm going to try to get in t—
my counselor. I'm going to show him the paperwork I was just sent by—
Attorney General's Office, stating that a court call has been set up for
that same morning. With any luck, I'll be able to make this telep—
appearance, at which time I can inform the judge as to what's been happe—
I have no doubt that I'm going to be told that there's a proper way t—
this, but at least I can make the attempt to get it on the record, and pe—
he might even understand that I can't pursue the proper avenue due to—
limitations imposed upon me.

I'm cautiously optimistic about my chances on Monday morning. My—
attempts were unsuccessful, in large part because he was on vacation, but—
actually a pretty good guy, so I'm hoping he'll be able to pull a few at—
to make this happen. Only time will tell...
