Subject: Violating Grievance procedures rendering grievances ineffective in violation of 42 U.S.C. 1997(e).

Staff at Union Correctional Institution is failing to return Informal grievances in accordance with 33-103.011. The informal grievances aren't making it back here to me, and some seem to not even be reaching the grievance coordinator to be logged in. And when I attempt to make the next step in accordance with 33-103.011 section (4), through the formal grievance, please refer to grievances log # 1908-213-079 and 1909-213-038. You see where they're saying no grievance was filed on that day concerning overcrowded recreation yards, where staff is putting 40 and 50 death row inmates on a yard that's not equipped in square footage to support 28 inmates. So rather than address this serious security issue and let me bring it to light, someone has clearly intercepted the grievance and discarded it. For this administration knows their placing staff convenience over security and the safety of the inmates for which they're packing on these yards like sardines. Again refer to formal grievance log #1909-213-038. This pulling grievances out of the grievance box was happening back in 2009-10 and a special grievance box was designed so grievances could not be removed. Over time the administrations discarded those boxes. And now once again we're having this issue.
And regarding grievance #1908-213-079 it shows staff removing photos from my tablet, that were in compliance with 33-FAC. and F.S. 847.001(9). Only to have this administration remove them. They said this informal grievance was responded to and mailed back to me on August 1,2019. But one it never reached me. And secondly, if it was mailed back on August 1, it would have been in noncompliance with 33-103.011 section (3). (a) ten day time frame. For it should have been responded to and returned on July 28. They could and should have attached the Informal grievance that they say was mailed to me on August 1, rather than render the grievance ineffective. Which leaves me no other alternative than to file this formal complaint.
RELIEF SOUGHT :
Classification or a designated staff member to handle all grievances. Where when picking up grievances they will keep a log book of what grievances are picked up, date time cell location, inmates name and number and who picked it up. When grievances are responded to, they will no longer be sent through routine mail, the designated staff member will be in charge of ensuring that all grievances are returned to the proper inmate. This will ensure a fair and effective grievance system is in place for all special housing inmates.
