I Ronald Wayne Clark Jr duly declare under the penalty of perjury that the below statement/facts are true and correct.On Thursday morning September 19,2019. I was unsuspectingly transferred to RMC for a medical procedure. When I returned two weeks later on Friday October 4., my property was already in cell P4128 stacked up all over the bunk. Before I even had a chance to go through it, for I had to clean the rust out of the lockers and line them with paper to keep the rust off my property, before storing it. While doing this our property room Sgt., Sgt Garrett came down with the DC6-220 inmate property forms and asked me to sign them. I complied. For it would have taken 30 to 45 minutes to check every item of property listed. As I began to store the property, I start noticing more and more items missing. And these items are not listed on the DC6-220 inmate property forms. No these items where clearly taken during the inventor process. For which Sgt Wood and Co White had conducted. I had never had a problem with these officers. In fact it was my favorite shift, so it was hard for me to accept that they would steal from me. I even stated that in the formal complaint that I filed on October 7,2019 and the grievance #213-1910-0098, also seen in Formal Grievance #1910-213-119 which was filed on 10/28/19. On the morning of Monday October 7, I stopped Sgt Wood at approximately 6:30 am and talked with him about the missing property,stating that I'm mainly concerned about my address book. Sgt Wood stated," I've got a wing to run, I don't have time to sit there with the property the whole time, I've got wing checks to make call outs to pull ect ect." I said"yes I understand that." Many times I had returned from call outs to see other inmates property spread out all over the Quarter deck, with no one supervising it. I then stated, "What we need is a procedure where the property is inventoried in the cell, in our presence, or taken to the property room and inventoried." Sgt Wood agreed with me. And he left.I filed the grievance that morning. Co White was with the grievance lady. He said" That's not on us is it?" I said its on my missing property. A few days later he made a comment about getting a phone call, from someone up top, concerning my property. I was doing something else, so I didn't pay much attention. I didn't think there was a problem.
Then on Thursday morning October 17, I was pulled by Co white for medical. He sits me in front of the clinic, in my walker and leaves me. Sgt Blue our administrative Sgt walked by and seen me unsupervised. Said nothing about. One of the yard officers, Co Crosby was brought in by officer to sit on medical. On his way in Co White I formed him I was next. Co Crosby stopped and rolled his eyes and continued into medical. He then stuck his head out the door and said in a nasty manner, "Why aren't you in the holding cell?!!" I responded, "I don't know." He then said again in a nasty manner, "Sit right there and don't move!" I informed him that I was going to file a complaint on him for speaking to me in that way. He walked back in to the medical clinic, then opened the door again, and said "your going to file on me?" And went to writing something in his little note pad. I then seen my classification officer Mrs Mahoney, I said can I speak to you for a second, I said you see I'm sitting here unsupervised, at that time the officer that was over by the control room approximately 25 feet away, around the corner away from where I'm sitting, comes running over, he's not unsupervised," I'm right here!" He then took me and placed me in the holding cell, where I originally should have been placed.
After being seen by medical. Co White put me up, and he talked me out of filing the complaint. And I agreed not to do it. Co Crosby then came down about 11:30 am and we spoke putting it behind us.
Then on Friday October 25, at 2:00 pm Co White comes to my cell front, and says," Pack it up your being moved to 4101 and placed under investigation." I said, "What for?" He said, "I don't know but we don't like all this attention over here." He left. And I was placed in this cell 4101 on administrative confinement, where according to 33-602.220 (2)(b) I should have been afforded an opportunity to make a verbal and written statement. Which they denied me of. They also didn't comply with section (2) (c). and conduct an ICT hearing within 72 hours. Which they've admitted to in informal grievance 213-1910-0291. Where Mrs Mahoney's response" Per Mr Andrews, classification supervisor, you are not in general population, therefore the rule is not applicable. Your grievance is denied." The rules are written and structured where they do not exclude me. I'm currently waiting on the grievance concerning the violation of (2),(b) where they wouldn't tell me what the investigation entailed, and by not doing so refused to let me make a verbal or written statement and by not complying denied me due process. I've also been informed that this Disciplinary Report #213-191416 which contains a HIPAA violation, is a falsified DOC document, in violation of 33-208.002 rules of conduct as well. For a reliable staff member who I will not divulge, and put him at risk for retaliation, informed me that this DR was not written by Sgt Wayne Wood as is stated, but it was written by a member of classification. If this is true, this ICT has engaged in unlawfully conduct, and violated my medical rights under HIPAA. I WILL TAKE A POLYGRAPH EXAM TO SUPPORT THIS CONFIDENTIAL INFORMANTS OFFICERS STATEMENT TO ME. But I will not allow this administration to retaliate against an honorable ethical correctional officer who merely detest the lies and falsification of this document/Dr#213-191416.
