CEE: So basically you are of the party who thinks every criminal act is committed by a raving lunatic who will not hesitate to use deadly force as a means to a desired end? Or perhaps you feel as if criminals should be punished for acts which possibly could have happened, but did not... There are thousands of human beings serving draconian and oh so harsh, lengthy sentences in some of the worst conditions on federal radar, but hey, maybe that is what they deserve! Right? Okay, maybe I went too far, but I have personally not ever considered breaking into a dwelling that was inhabited. My "M.O." or Modus Operandi, as it is called in legales, is an opportunistic daytime burglary while the occupant(s) are away. A criminal who enters a home with inhabitants on the premises is clearly and unequivocally willing to cause death or serious injury to the owner(s), whereas I sought no confrontation in fear of doing harm or, inversely, having it done to be my the surprised and @#%ing pissed occupants. In fact, the majority of burglars in prison who are non-violent offenders, spent several minutes, probably, ensuring that no-one was at the residence before they enter it, and they entered with the "specific intent" to steal, not kill, rape, or otherwise see anyone. But I am aware of burglaries gone wrong too, where the owner shows up and confronts the thief, it can go and does go bad sometimes, but that is completely up the thief and/or the owner. For instance, if the thief is confronted by the owner he could choose to run away. This would preclude any chance of fight with the owner which can lead to a worse crime, i.e., robbery, which is a violent offence, (or a crime against a person) but subject to different laws and punishments.
