RE: Classification Response
Dear Ms. Fitzgibbons:
I am writing to thank you for your correspondence dated 2/6/2013, which I've just received.
I was transferred to this institution on 2/8/2013. Needless to say that I am now housed in segregation, based upon my filing for a early classification review date or hearing.
Because there are no programs, job opportunities nor educational programs for me, as a first degree lifer; I am not allowed any of my art supplies... nor a musical instrument, and I know if I stay in this prison facility with the mind frame that I am in... I might do something I will later on regret doing as - "assaulting a staff or an inmate".
Because I am forced to live with some real ignorant ass dudes that want to stay up all night and sleep all day... and every other word out of their mouths is [blank] this, or [blank] that!!
I was born down South, and I cannot or will not stand for any type of negative connotations.
The other problems that I am constantly faced with is running into various Dept. of Correction staff or correctional officers who are friends with the victims... and their family members who also work all throughout the Depart. of Corrections, with condescending attitudes and personal idiosyncrasies against me, which in general makes a bad environment for me to be in.
Ms. Fitzgibbons, what also was not explained in my letter to Commissioner Luis Spencer, is the type of classification hearing that CPO Earnest Williams had did... as well as; had spoken with Ms. Stacia Span, and during their conversation, they both had noticed and suggested that after November 18th 2012, my point leave score would be as low as eight points, and that he, as well as Ms. Span, would like to bring me back before another classification review within 90 days from that point of my prior class to highly request that I be sent to NCCI Gardner.
Where I had did quite well when I was there... if I agreed to the 90 days review and waived my appeal process, it would be a guarantee.
So, Ms. Fitzgibbons, not only was I duped into a transfer but waiving my rights to appeal in accordance with 103 CMR 420.08 (3)(h) appeal process.
It was on February 7th 2013, "a day before I secured my decision of my transferred"... that I had learned my move was modified. CPO Williams looked me in the eye and stated "It's that dame Kathleen Doyle again"!!
At this point and time I would rather be housed back in [illegible], or even [illegible] than be housed at this institution.
