Dear Mr. Clark:
Your recent correspondence to Postmaster General Patrick R. Donahoe, concerning intercepting, withholding, or censoring of mail, including confidential medical information, was referred to this office for review.
We understand your concerns; however, the situation you describe does not come under the authority of the US Postal Service. Federal court decisions concerning the right of inmates receive and send correspondence and the authority given to prison officials to censor incoming and outgoing mail have been based on constitutional grounds, not on violations of Postal laws.
As information, mail addressed to an inmate of any institution is delivered to the institution for internal distribution as appropriate. At the point of delivery to the facility, the responsibility of the US Postal Service ends. Authorized personnel of prisons, jails, or other correctional institutions, under rules and regulations set forth by the institution, my open, examine, and censor mail set from, or addressed to an inmate of the institution. Federal court decisions concerning the right of inmates to receive and send correspondence and the authority given to prison officials to censor incoming and outgoing mail have been based on constitutional grounds, not on violations of Postal laws.
