QUESTIONS OF A LEGAL NATURE
Saturday
April 9, 2016
As most of you already know, I'm currently incarcerated in the Mule Creek State Prison (MCSP), one of more than 33 prisons controlled by the California Department of Corrections and Rehabilitation (CDCR). While in the California Men's Colony (CMC), which is where I was prior to being transferred here, I was injured as a result of a "medication error" committed by a pharmacist in the prison pharmacy. Since that time, I've tried to find someone willing to represent me, but while everyone who responded stated I had a case, none were willing to spend the time and money going up against a State entity with an unlimited budget. As they pointed out, State entities have shown, time and time again, that they have no problem whatsoever with spending millions of dollars to avoid paying a plaintiff, even if the plaintiff was only seeking a few grand.
Since I couldn't find someone to represent me, I thought I'd post a basic letter trying to see if there was someone out there, not necessarily a lawyer, just someone with a basic understanding of the law, a paralegal, legal secretary, law student, etc., who might be willing to assist me with finding answers to a variety of legal questions. For instance, how would an indigent pro per litigant in an unlimited civil action go about conducting a deposition when he doesn't have the money necessary to pay the stenographer, witness fees, etc.? In such cases, is the court authorized to pay these expenses, as it would in a criminal case? And if so, what code sections or legal precedents would I cite to convince the court to make such a ruling?
On a related matter, is it possible to convince the court to appoint an expert witness to testify on my behalf in an unlimited civil action in a California State court? Without it, I have no way of proving the link between the act of negligence and the injuries suffered as a result.
I should point out that, if the court is able to do what I've requested, I have no doubt that they're going to want to be reimbursed if I win my case, and I have no problem with this. My only concern as of this moment is finding a way to retain the services I need, stenographer, expert witness, witness fees, etc.
If you know the answers to any of these questions, or know of someone I might be able to contact, please leave a response here, send an e-Mail to shawnLperrot@hotmail.com or send me a response via snail mail to the address listed below.
Thank you, in advance, for any help you might be able to give me.
