Subject: Contract Dispute
I'm putting my education to use already. I'm currently engaged in a dispute with the DOC and GTL over the removal of the songs from my tablet.
On 4/6/17, twenty-three songs were removed from my tablet by the DOC and GTL because they were deemed "restricted" material due to its obscene, explicit or sexual content. I filed a complaint with the GTL company. Their response was: "Please be advised that your access to any song or track that is currently or subsequently deemed to be restricted by the PA DOC due to its obscene, explicit or sexual content will be blocked by GTL. As a result, you will not be able to download, access or play a restricted song or track on your table. Please further be advised that you will not be given a refund of the purchase price of a song or track that you were able to download but that is subsequently deemed to be restricted by the PA DOC. Upon your release from DOC custody, however, GTL will give you a one time opportunity to download any restricted son or track that you purchased but were unable to access."
Thees people knew that the songs I purchased were restricted material and yet still permitted me to purchase the songs they now remove. This is evidenced by the fact that in November, they restricted very similar songs/tracks by this same artist.
I'm seeking a refund in the amount of $43.93, the cost of the songs they permitted me to purchase after they knew I wasn't permitted to keep them. It's not right that I'm subjected to this theft, as they attempt to hide behind policies they made up to cheat us. How is it right for them to allow us to purchase these songs, only to sweep by later to take them and not provide a refund? The fact is, their policies aren't the law, and the law states that what they done constitutes as a "conversion"—the wrongful taking of property. If they didn't want us to have it, they shouldn't have sold it to us. Can't let them keep taking advantage of us. Knowledge is power.
