ISSUE: The appellant is submitting this appeal relative to Board of Parole Hearings support letters, religious curriculum accomplishments, and other positive letters pertaining to self-help, to be scanned into the ERMS file.

INTERVIEWED BY: Not applicable for First Level Appeal. The interviewer will be conducted at the Second Level Review by a Correctional Case Records Supervisor, (CCRS) or above if appropriate.

REGULATIONS: The rules governing the issues are: Board of Parole Hearings rules, regulations, timelines, and Case Records Procedures regarding scanning support letters, book reports, and certificates.

The appellant was received into the Department of Corrections and Rehabilitation, (CDCR), December 18, 1997, Yuba County Superior Court Case# C10210, for Possession of Explosives in a Public Place and sentenced as a Third Striker for a term of 25 years to life. August 18, 2000 he received an additional commitment do to committing an in prison offense, Assault by Prisoner with Deadly Weapon or force Likely/GBI, Sutter County Court Case# CRF992420 an additional 27 years to life to run consecutive, for a total prison term of 52 years to life.

The appellant is requesting that all the supportive documents to be scanned into the ERMS file for future parole consideration hearings. A review of the Board of Parole Hearings, (BPH) section, it was discovered that two of the documents were previously scanned into ERMS. The letters dated March 10, 2017 and the letter dated June 14, 2017 both from the same person. You've already attended your consultation hearing on August 03, 2017, and you are going to be scheduled for the Initial Hearing when the date is closer. The appellant can submit additional documents to the attorney for submission to the Board of Parole Hearings as exhibits for review and consideration.

A review of your commitment offense reveals that you are convicted from Yuba County, Case number C10210 for a total indeterminate term of 25 years to Life. You have a consecutive term from Sutter County, Case number CRF992420 for a total indeterminate term of 27 years to Life. Total Term imposed 52 years to Life sentenced pursuant to Penal Code 667 (b)-(i).

On May 24, 2016 you were identified as being entitled to a Board of Parole Hearing, Consultation. The hearing was to be scheduled to a date "No Later Than" (NLT) February 15, 2018. During the period of time between May 24, 2016 and February 15, 2018, documents relevant to your case, such as support letters, opposition letters, and documents that provide testimonials will be received in Records and placed in your file.

It is noted at the First Level Review that two of the documents appellant requested be placed in the file, had already been scanned in the file, however the request to have the remaining documents (testimonials) placed in your file was denied.

Pursuant to Initials/Subsequent/Rescission Hearing procedures, Documents in Support of Release: Any supporting documents that are not classified as "Confidential" by the Classification and Parole Representative will be scanned into ERMS under BPH>Parole Proceedings>Letters of Support (testimonials).

3041.7. Parole release dates; inmates under life sentence; hearings to set, postpone or rescind; representation and notice

At any hearing for the purpose of setting, postponing, or rescinding a parole release date of * * * an inmate under a life sentence, the inmate shall be entitled to be represented by counsel and * * * Section 3041.5 shall apply. The Board of Parole Hearings shall provide by rule for the invitation of the prosecutor of the county from which the inmate was committed, or his or her representative, to represent the interests of the people at the hearing. The Board of Parole Hearings shall notify the prosecutor and the Attorney General at least 30 days * * * before the date of the hearing.

Notwithstanding Section 12550 of the Government Code, the prosecutor of the county from which the inmate was committed, or his or her representative, who shall not be the Attorney General, except in cases in which the Attorney General prosecuted the case at the trial level; shall be the sole representative of the interests of the people. 3042. Parole-review hearings for inmates serving life sentences; notice requirements; procedures

(a) At least 30 days before the Board of * * * Parole Hearings meets to review or consider the parole suitability * * * of any inmate sentenced to a life sentence, the board shall send written notice thereof to each of the following persons: the judge of the superior court before whom the inmate was tried and convicted, the attorney who represented the defendant at trial, the district attorney of the county in which the offense was committed, the law enforcement agency that investigated the case, and where the inmate was convicted of the murder of a peace officer, the law enforcement agency which had employed that peace officer at the time of the murder.

(b) The Board of * * * Parole Hearings shall record all those hearings and transcribe recordings of those hearings within 30 days of any hearing. Those transcripts, including the transcripts of all prior hearings, shall be filed and maintained in the office of the Board of * * * Parole Hearings and shall be made available to the public no later than 30 days from the date of the hearing. No inmate shall actually be release on parole * * * before 60 days from the date of the hearing.

(c) At any hearing, the presiding hearing officer shall state his or her findings and supporting reasons on the record.

(d) Any statements, recommendations, or other materials considered shall be incorporated into the transcript of the hearing, unless the material is confined in order to preserve institutional security and the security of others who might be endangered by disclosure.

(e)(1) The written notice to the judge of the superior court before whom the inmate was tried and convicted shall be sent by United States mail.

(2) The judge receiving this written notice may forward to the * * * board any unprivileged information from the trial or sentencing proceeding regarding the inmate, witnesses, or victims, or other relevant persons, or any other information, that is pertinent to the question of whether the * * * board should grant parole or under what conditions parole should be granted. The judge may also, in his or her discretion, include information given to him or her by victims, witnesses, or other persons that bear on the question of the inmate's suitability for parole.

(3) The * * * board shall review and consider all information received from the judge or any other person and shall consider adjusting the * * * conditions of parole to reflect the comments or concerns raised by this information, as appropriate.

(f) Nothing in this section shall be construed as limiting the type or content of information the judge or any other person may forward to the * * * board for consideration under any other * * * law.

(g) Any person who receives notice under subdivision (a) who is authorized to forward information for consideration in a parole suitability hearing * * * for a person sentenced to a life sentence under this section, may forward that information either by facsimile or electronic mail. The Department of Corrections and Rehabilitation shall establish procedures for receiving the information by facsimile or electronic mail pursuant to this subdivision. In the past, he was responsible for getting dozens of inmates onto extension courses of Dianetics and Scientology, and thus changing their lives. In the present, he has formed a group and has been getting inmates Dianetics and Scientology; including The Way To Happiness. This has resulted in dozens of success stories and changed lives. Recently, one such individual was released from a California State Prison after being in prison for 22 years and credits Scientology and Mr. Goehler with helping him change his life, get off drugs, get others off drugs and to be released from prison and start to lead a productive life and is currently on lines at an Ideal Organization of the Church of Scientology. Mr. Goehler was responsible for this and started this individual studying Scientology about two years ago.

Another person from Mr. Goehler's group, had been released over a year ago and the first thing he did was to visit a Church of Scientology and was reportedly still doing well.

Mr. Goehler helped to found a Scientology study group in prison which is called Scientology Prison Outreach (SPO); which continues to grow at Mule Creek State Prison.

To Whom It May Concern:

I have known Mr. William Robert Goehler (CDCR# K-77832) since October 2013. I have met with him personally at Mule Creek State Prison in the course of doing some volunteer work there. I have corresponded with him and have spoken with him many times over the phone.

Although sentenced to life in prison, I recently became aware that Mr. Goehler was being considered in some fashion for parole. I thought that I should write something about him for his case-file.

I chose to represent my knowledge of Mr. Goehler in terms of his search in the field of religion, as that has been the main subject of my association with Mr. Goehler. Before you dismiss this as irrelevant, please hear me out.

It is my contention, and one which has been well established in the annals of human nature; that Mr. Goehler's search for self-awareness in terms of religion has everything to do with his improvement and consequently his propensity to commit crime again, or not; and his "dangerousness" to the environment around him or not.

The relationship I've developed with Mr. Goehler was very connected to the religion of Scientology. The word Scientology means KNOWING ABOUT KNOWING, or SCIENCE OF KNOWLEDGE. Our programs in the area of criminal rehabilitation have reduced recidivism from 70-80% in some countries to zero or very small numbers.

At the present writing, religion is perhaps not seen by some as being relative to the subject of criminal rehabilitation; however, I beg to make a point here. If we define religion as below, then it has a great deal to do with whether a criminal could be considered to be changed and worthy of parole:

"In a few words, religion can be defined as belief in spiritual beings. More broadly, religion can be defined as a system of beliefs and practices by means of which a group of people struggles with the ultimate problems of human life. The quality of being religious implies two things: first, a belief that evil, pain, bewilderment and injustice are fundamental facts of existence; second, a set of practices and related sanctified beliefs that express a conviction that man can ultimately be saved from those facts."

Furthermore:
"When religion is not influential in a society or has ceased to be, the state inherits the entire burden of public morality, crime and intolerance. It then must use punishment and police. Yet this is unsuccessful as morality, integrity and self-respect not already inherent in the individual, cannot be enforced with any great success. Only be a spiritual awareness and inculcation of the spiritual value of these attributes can they come about. There must be more reason and more emotional motivation to be moral, etc., than threat of human discipline."

I am certain in my evaluation that Mr. Goehler has been genuine in his search for real answers to the questions he has been facing in his life and how he wound up incarcerated. I am also very certain what I have done to help Mr. Goehler in this regard and how he has manifested the desire to help others using this knowledge; and how he desired to continue improving himself and continue to help others should he be paroled. To my personal knowledge he has helped several inmates to be able to study things they were trying to learn so as to improve themselves. He has also helped other inmates with trying to understand themselves and where they went wrong. The ability to help is most certainly a test of sanity of one type or another. Several inmates who participated in these studies had gotten out and reportedly continued those studies. One such individual (Joe Bush CDCR# J98680) was released (Currently transitioning in a half-way house) relatively recently and I have been in communication with him almost daily. Mr. Bush was incarcerated for 22 years before his parole (12 years early) and is now doing very well in readapting to life in the community. Mr. Bush continues with his affiliation and study of Scientology and continues to help people in the community. Mr. Goehler had introduced Mr. Bush to these studies while at Mule Creek State prison. In addition, Mr. Goehler had been active several years ago to get dozens of other inmates to study and improve themselves. Some of this study includes the knowledge of how to study anything, the nature of man, ethics and moral codes and how to abide by them.

There is no false representation herein or by Mr. Goehler to myself. I am aware of his faults, but nevertheless do not feel he is a danger to anyone; especially now that has a purpose to help others and better the society around him. I am not naïve in these opinions of the possibility that something could go wrong; but I am willing to help Mr. Goehler as much as possible should he be paroled and certainly he seems to deserve the chance to redeem himself. I will continue to assist him in any way that I can regardless.

I was recently released from prison on February 13th of 2017, after serving 22 years in California state prisons (All level 4 prisons the whole time I was in). I was involved in riots and five SHU (Secured Housing Unit) terms. My last one was an indeterminate Pelican Bay SHU. I decided I wanted to turn my life around, but found myself still dealing with conditioned behaviour, and wishing I had some way to deal with these conditioned behaviors, these thoughts, emotions and actions that I've done so often in my life. Like getting extremely upset with certain things that would happen in life and not being able to control them. In the past; I had always used drugs, alcohol or violence to deal with these problems. I was trying to find a new way to deal with these things when I met William Goehler at Mule Creek State Prison.

Mr. Goehler asked me to attend a religious program he was facilitating called, "Scientology (Which has to do with knowledge and practical solutions for life) Prison Outreach", a program at Mule Creek State Prison. I started attending this group there and learned tools to deal with adversity, to deal with my condition, my behaviour, and I helped him facilitate the program. We studied this methodology and I began practicing it in my life more and more. My life changed because of this, and because of Mr. Goehler's help; I was able to get out of prison 12 years early.

I owe 12 years of my freedom to Mr. Goehler, and in fact, if it wasn't for him and what he did for me; I wouldn't have the ability that I have now in society to help others. I now manage a company and make $1,000 a week. I'm able to plan ahead in both my business sense and in regards to a family, which I would like to have in the future. I'm able to help others because of what he taught me. I'm able to care about life now where I didn't before. I'm able to see people as people and see a community as something I'd like to participate in and belong to and help, because of William Goehler. My life has changed for the better, and people all around me see it. I just wanted to thank him by sharing this with the parole board. Mr. Goehler is an incredible person who has changed my life and I can't thank him enough.

Components of Understanding

What is the ARC Triangle? How does it apply to me?

The abbreviation of the ARC Triangle represents:
Affinity
Reality
Communication

*Affinity is defined as "a degree of liking or an emotional attitude towards a person(s), animals, or any objects animate or inanimate." The basic definition of affinity is the consideration of distance whether good or bad. The basic function of complete affinity would be the ability to occupy the same space as something else.

*Reality is defined as "that which appears to be." Reality is basically an agreement. What we agree to be real is real.

*Communication is defined as "a shift of particles from one space to another." Communication is broken into four categories. By way of objects, by way of written messages, by way of spoken words and finally by way of ideas.

In order for this technology to operate at full capacity, two of the three points must be established. Any point of the ARC Triangle can be established without priority. The most important point to consider is communication, because communication is the key to solve all, if not most problems. IF these points can be achieved, it would approach the true meaning of understanding.

This technology is valuable and can be applied to any aspect of life. Here are a few exampled of how it applies to me.

Example #1

There was this guy who was angry about something or about someone. I could tell that he was angry because his body language was tense and his demeanor was hostile. He kept mumbling and appeared to be agitated. How do I communicate with him? Without having my communication being shunned or possibly ignored. I had to reason with myself to understand his frame of mind. I am thinking, this probably wouldn't be a good time to approach this man given that 1) he may be unstable and might direct his anger towards me, 2) he might behave irrationally and become extremely prone to violence. These conditions are dangerous. However I know this individual can be approached if I apply the technology correctly. I took the challenge and decided to confront him.

The first step I took was to examine the symptoms and state of obvious. He is angry. The next step was to validate that anger by feeding into that person's reality. By acknowledging his anger, I had created a duplication of that reality by simply agreeing with him. By doing this, it helped me develop the first point of the ARC Triangle. Since we have come to an agreement about his sense of anger, I was able to close the distance between me and him. Soon thereafter, we automatically developed a liking towards one another and made it possible for us to communicate. Hence affinity was born and our communication line connected. He had expressed to me about how he felt and what caused him to be in that state. I offered a few suggestions and he began to settle down and his emotional tone changed.

In conclusion, I was able to solve not only his problems, but I had redirected a new course of action and prevented him from doing the unthinkable. He had regained control of himself. The ARC is useful. As you can see from the start; all three points were established and as a result, it had heightened our understanding of the situation and gave us the ability to resolve it.

Example #2

There was this lady who always acknowledged me every time she sees me. I really have no idea who she was. I didn't really know exactly what to say. After all, she was a total stranger and yet she appeared to be very nice in character. The situation made me perplexed. The problem was my inability to communicate. However, communication was not impossible.

I began to apply ARC to see if I could raise the level of our understanding.

The first step I took was stating the obvious. She's nice. I also notice she carries books with her, telling me she likes to read. I stopped her one day to casually converse with her. I discovered she is into philosophy, judging by the books she appears to be reading. She was very receptive to philosophical ideas and we went into great length in our discussion. Our communication had heightened, and I realized affinity and reality were created simultaneously, so it had worked out perfectly.

As a result, we developed a good rapport with one another and became friends.

In conclusion, to this report, the components of understanding require the ARC concept to formulate. I know beyond at reasonable doubt that this technology works. With this realization, I know how effective it can be to improve conditions and start new relations. I am happy with my findings thanks to this technology.

Success

Since I've been studying the materials provided, I've had a number of experiences (which I know are also termed "wins") which have really opened my eyes to the manner in which they are applied because not only does it make so much sense that it falls in line with that I already know to be my reality but also takes a very scientific approach into describing facets of life I already semi-understand or in other cases was confused about. Each of these experiences has had a clear moment of eye opening bliss. I'd like to recount some wins for your benefit.

1) Through the last 20 years I've experienced many coincidences that seemed to be extremely mysterious in their astronomical improbability. I constantly tried to make a connection in my mind to how I experienced so many and the feeling of vast enormity that I get from them. Sometimes I wondered if it meant something, most times I figured I was just lucky to experience them, a minute confluence of events in a giant stream of uncontrollable MEST (The Physical Universe).

The week before I began my studies into Scientology, I heard of a specific scientific theory that touches on just a part of this phenomenon I refer to. It speaks of the awareness of a thing being present very soon after you initially learn it. Well, I began my studies very soon after and this subject was brought up which was in accordance with what the theory explains. However, I also learn it is one facet of the phenomenon called synchronicity. This is a huge win for me because it is something I've wondered about for many many years and was brought up for consideration just days prior to learning about it and learning that I could learn more about it.

2) On the same subject of synchronicity: on the same day I began using the book Self Analysis; I had been earlier ruminating on how my physical reaction time has suffered and how the biggest pet-peeve I have is forgetting something that I put in the time and effort to learn. I began the book and within the very first few pages of the book that I decided to read the same day I had these ruminations, it explains that it can help both of these things.

Win, Win, Win!

The other day, someone put something on my door that was intended as a symbolic insult. Upon discovering the item, I initially became angry. I thought about confronting the person about what he did, and expressing my anger. However, I was able to reframe the situation by letting my anger subside. Thus, instead of confronting him angrily, I decided to roll with the joke and laugh with the person about it instead of reacting in anger. I consider my behaviour a win because I was able to overcome a seemingly impossible bout of anger.

Today, I went back to work after two weeks off. Prior to my vacation, I had gotten into an altercation with a co-worker that was personal. I was unable to separate my personal emotions from my professional obligations, and as a result I'd been acting unfairly toward people. After determining to maintain my professionalism, I went back to work and was able to work and act professional. I consider my conduct to be a win because I worked hard to put my emotions aside and be professional.

After reading about the ARC Triangle, I've been able to reconsider things like my own conflicts and communications as well as other people's interactions, sort of reframing them in terms of affinity, communication and a new concept of "reality" to understand where things might have gone wrong and how they could go better. It's been pretty useful, I think.

MULE CREEK

The VM went in and spent about 3 hours with inmates. Chaplain Max S. was not there o he was Escorted in by Imam Younus.

7 people showed up.

They did TRs. OT TRO, TRO and TRO Bullbait.

The inmate "Hungry" went exterior while doing OT TRO bullbait. He could see the back of his head, could look at the person doing TRs with him, move around his head, etc. Then he went back into his head and couldn't see. He was wondering if this was ok and whether he was avoiding confronting by doing this.

One new guy came. Wanted to handle his GED.

"Whispers" didn't come today because someone was saying that he was the only person interested in Scientology and he wanted to prove that it wasn't just him.

Anthony said that he had wins. Anthony has come a few times but wasn't getting any wins and so it was good that this time he had wins doing TRs.

The inmates are talking about organizing up to open up on Friday's as well.

They will be doing more TRs next week and need to get Alice in Wonderland books in there fast so that they don't get stopped at TR1. Everyone is going to bring one person with them new to the group next week. They are also going to print up flyers to use as promotion.

My Experience with the Basic Study Manual
The Scientology Basic Study Manual has worked wonders for me! As someone who has read a fair amount of books, I though that my study habits and methods of approach when it comes to acquiring knowledge were good enough; but the Scientology Basic Study Manual taught me to slow down and be more through in my approach to studying.
At first, I looked at the manual, with its illustrations and simple language, and thought that I was too advanced a learner to gain anything out of it. How wrong I was! Learning the "Barriers to Study" - having an absence of mass, and too steep a gradient - has helped me understand why, in the past, I have learned some subjects that I've studied better than others. And every time I thought of an instance in which I did not grasp a topic, it was because I either didn't have a hands-on way to demonstrate or view what I was reading about (an absence of mass), or I tried to learn too much too quick and would get ahead of my own ability to grasp the material that I was trying to study (too steep a gradient).
Learning such basic skills as the use of a dictionary is of infinite use, to both the beginner and the advanced learner. For the beginner, the Basic Study Manual provides a valuable and useful starting point that is easy, straightforward, and helpful. For the advanced learner, the manual provides a greatly articulated reminder of the importance of looking up and "clearing" (misunderstood) words.
The Basic Study Manual has been of great use to me; and I am thankful to have had the chance to read it.
