Dear Officer Kraemer:

Although I was surprised at your kind gesture by sending me the ten (10) pages of incident reports dated March 12, 1991 in homicides M2410-M2411 last week, in reading those reports I did get the chance to finally conclude that they are in fact part of the pretrial discovery materials in which we received from the Milwaukee County district Attorney's Office relative to State of Wisconsin v. Scott Alan Heimermann (Milwaukee County Circuit Court Case No. 1991CF911618) in 1991. But, given the fact that the 10 pages of reports that you sent to me are unredacted, as the version of the original ones we received previously were in fact redacted in many aspects, does breed optimism that we are now going to make some real progress since you received our open records request on July 13, 2012 for the information called "Itinerary of the 'As-Yet-Undisclosed-State-Evidence.'"

In the meantime, here's what I propose that we do to ensure that I receive the remaining unredacted reports the Milwaukee Police Department has according to the 'Itinerary of the As-Yet-Undisclosed-State-Evidence': Please find enclosed copies of Affidavits of Edward J. Piscitello dated December 28, 1999 and September 10, 2002, with the June 20, 2000 statement of former U.S. Customs Agent Buford Gates and the Memorandum Dated April 21, 1991 from IRS Special Agent Michael Spang to Milwaukee Assistant District Attorney Jon Reddin with the redacted Milwaukee Police Incident Report dated March 21, 1991 and the Milwaukee County Sheriff letter dated March 18, 2007 addressed to Attorney Ralph Sczygelski.[1] Please review these materials for purposes of confiming that the additional records sought herein do in fact exist in Milwaukee Police Department files.

For instance, please notice the enclosed sworm Affidavits of Mr. Piscitello correspond with the unredacted 10 pages of reports dated March 12, 1991 that you sent to me. Mr. Piscitello's sworn affidavits confirm that he is in fact the "informant" mentioned throughout those 10 pages of

reports. (See e.g., paragraph 6 of Piscitello 12/28/99 affidavit; paragraphs 3-11, 21-22 of Piscitello's 09/10/02 affidavit.) In addition, you will see the Affidavits of Mr. Piscitello also correspond with the "Eddie P." mentioned in the unredacted version of the enclosed redacted incident report dated March 21, 1991. (See paragraphs 7-9, 11 of Piscitello's 12/28/99 affidavit; paragraphs 3-11 of Piscitello's 09-10-02 affidavit.)

Accordingly, upon checking Milwlaukee Police Department files, please send to me the unredacted version of the following records: First, I am requesting a copy of the unredacted version of the enclosed Milwaukee Police Incident Report dated March 21, 1991.

Second, I am requesting any and all unredacted records that the Milwaukee Police Department has for the "drugs-for-guns" investigation regarding Muhammad D. Binwalee, B/M, 06-02-67, who was also going by the street names "Anthony C. Bryant: and "Tony Charles" (a.k.a. "T.C."), from January 1, 1989 to August 31, 1989.

Third, I am requesting any and all unredacted records that the Milwaukee Police Department has regarding Edward J. Piscitello, W/M, being involved as the Milwaukee Police Department informant in the drugs-for-guns investigation regarding Muhammad D. Binwalee and his gang affiliates in the Black Gangster Disciples organization, from January 1, 1989 to August 31, 1989.

Fourth, I am requesting any and all unredacted records that the Milwaukee Police Department has for the March 21, 1989 arrest for "Anthony C. Bryant," B/M, 06-02-67, as well as the fingerprint records relative to "Anthony C. Bryant's" March 21, 1989 arrest.

Fifth, I am requesting any and all unredacted records that the Milwaukee Police Department has for Scott A. Heimermann, W/M, 09-23-60, contacting the Milwaukee Police Department in late July 1989 before Muhammad D. Binwalee and Dion Russell were gunned down and the reason for Mr. Heimermann doing that was because to warn of Mr. Piscitello's ongoing violent tendencies.
