RE: GOVERNOR BAKER SILENCES PRISONER "FREE SPEECH" COMPLAINTS

Timothy J. Muise, a well-known prisoner rights activist, was written a Department of Correction Disciplinary Report No. 330309 on February 12, 2015, by the Department Deputy Karen L. DiNardo. The Disciplinary Report was issued due to the fact on January 5, 2015; Mr. Muise had written to the Office of Governor Charles Baker stating the following:

"What I am suggesting is that you (Charlie Baker) come here to MCI Shirley and speak to a panel of prisoners about the corrections system. I can assist you in putting the panel together. Thank you for your time and anticipated serious consideration in coming here to the prison to meet with a panel of prisoners. Please let me know what I can do to assist you in making this happen."

This is the EXACT text of the disciplinary report as it appeared in the "Offense Description".

Governor Bakers office forwarded Mr. Muise's letter to the Department of Corrections for response and this is how they responded; writing him a disciplinary report that would ultimately extend his prison sentence by 5 to 6 months!

This is a clear effort to silence the constitutionally protected complaints of a prisoner in the charge of the Commonwealth. It will prove costly to the state once it reaches the State Courts. Mr. Muise recently prevailed in another "free speech" matter with the Department of Corrections settling with him in the amount of $10,000.00 (see Timothy J. Muise Vs. Gary Roden & another, Suffolk Superior Court No. SUCCV2011-0869). This latest move to chill Mr. Muise's free speech will ultimately result in more financial costs for the state.

Mr. Muise would like to speak to the media about the abuse at MCI Shirley and system wide, while elaborating upon what he planned to tell our newly elected Governor through the panel discussion. This surely cannot be the type of "tone" Governor Baker wants to set for his governorship; one of a man who silences constitutionally protected free speech.
