Cruel and Unusual Punishment

"CRUEL and UNUSUAL PUNISHMENT"
This cruel end unusual punishment is derived from the Eighth Amendment to the United States
Constitution, which states, "excessive bail shall not be required, nor excessive fines imposed,
nor cruel and unusual punishment inflicted." U.S.C.A. Conch Amend. VIII. Now this provision is
applicable to the states through the Fourteenth Amendment. The protection flows from the
basic "precept of justice that the punishment for crime should be graduated and proportionate
to the offense." Atkins v. Virginia. 538 U.S. 304, 311(2002) (quoting Weems v. United States,
217 U.S. 399,387 (1910)). Eighth Amendment jurisprudence has seen the consistent reference
to "the evolving standards of decency that mark the progress of a maturing society.")
We talk a lot about the cruelty and inhumane methods of a punishment here in America. And
those punishments which violate the standards of the 8th amendment of the United States
Constitution. Because in most cases we are killing/murdering a convicted murder, who is guilty
of the crime, we overlook the inhumanity of this barbaric act that we are inflicting upon the
family of this convicted murderer. Let's face it, truth be told the final act of killing this individual,
once completed, puts the individual who you're, "murdering under the mantel of Justice," out of his
or her misery. But what we fall to realize and acknowledge, is the cruel and unusual punishment,
for which we as a civilized society, are now inflicting upon the families. For this is the most
devastating act of premeditated murder upon that family, who has frankly been unlucky enough
to have their loved one sentenced to death. And for this they are victimized by the government.
Think about the anguish, pain and unspeakable human misery that the mother, father, brother's
and sister's and other loved ones are put through as their loved ones are killed. This is in and of
itself, an Eighth Amendment violation. You've got that family witnessing the state take
vengeance upon the person they love. A family victimized!
Now let's take for instance Melissa Lucio, an innocent woman who's scheduled to be murdered
by the state of Texas on March 27,2022. You can see her entire story over at:

I encourage you to not only view this, but to then speak out about the atrocity of injustice that
has taken place, not only against Melissa Lucio, but the entire Lucio family who's being
victimized by an overzealous judicial system, that is hellbent on murdering this innocent woman,
and in return victimizing her family in the process.
Guilty or innocent is irrelevant, when it comes down to our flawed judicial system that gives one
person life, and the other death for the exact same crime. SO a man or woman is arbitrarily and
capriciously sentenced to death and murdered by the state. When the other man or woman is
given life. One family will have to endure their loved ones murder. While the other family is
spared from this cruel and unusual act. So where is this evolving standards of decency that
mark the progress of a maturing society? Why is our judicial system willing to victimize innocent
bystanders who's only misfortune is having a loved one arbitrarily and capriciously sentenced to
death? Yes its time for those innocent family members to challenge this brutally barbaric and
unconstitutional act of murdering their loved ones, while scarring them with an emotional and
psychological trauma, that effects their physical health as well. Because that Eighth
Amendment is surely being violated. So I think our court's should hear this Eighth Amendment
claim. And the Lucio family should file suit against our government for putting them through this
blistering hell of premeditated murder, against Melissa Lucio. The time to act is now. The time
for change is upon us. God bless you. And fight for justice.
