32 years wrongful incarceration is unacceptable in a nation that proclaims itself to be the beacon of democracy. The case of Mumia serves as a daily indictment of the U.S. judicial system and all the grand claims about "innocent until proven guilty;" "beyond a reasonable doubt;" "jury of your peers;" "due process;" and equal protection of the law. The case proving Mumia's innocence is outlined in numerous books, websites, Internet articles, and most importantly court documents filed by Mumia's legal team.
Why then, you ask yourself, has Mumia been unjustly held in captivity? This is a good question that demands an honest answer.
Particularly in light of the fact that in 2011, Mumia's death sentence was declared unconstitutional and commuted to life without parole for supposedly murdering Philadelphia police officer Daniel Faulkner back in 1981. Despite "clear and convincing" evidence of witness tampering and perjury by the Philadelphia police—with the knowledge of the district attorney's office—for the purpose of detaining a conviction, no court in America has had the integrity to order a new trial or the dismissal of the murder conviction altogether.
In 2011, when Mumia's death sentence was declared unconstitutional, ordering a new trial as opposed to commuting Mumia's sentence to life without possibility for parole was the fundamentally fair process due. Anything else makes a mockery of America's judicial system, and the promises of Constitution of the United States.
