The DOC is engaging in its usual illegal activity again. Now they are failing to honor the Court's ORDER to reclassify me. The following is a formal DOC grievance I have filed about the situation. I will be next filing a motion to hold the DOC in contempt of Court.

They just can't get beyond the fact that they got caught retaliating against me at MCI Norfolk. In typical DOC brainwashing technique they sexually abuse prisoners. The prisoners come to me for help. I report the abuse and then the DOC paints me as the bad guy. They then "make up" a reason to discipline me (I helped organize an "outside" prison protest but the DOC pretended it was an "inside" protest I was organizing) and ship me off to the armpit of the universe: MCI Shirley Medium, a/k/a ShirleyWorld.

Complaint: MCI Shirley Superintendent Kelly Ryan has improperly calculated my seniority date as it applies to earning a single occupancy cell under the de facto seniority policy she confirms in her attached letter (Grievance Exhibit "A"). Ms. Ryan has listed my seniority date as: June 3, 2011. This is fully inaccurate under any calculation scheme, but I will put forth my two "evidence supported" accurate date calculations. First, my seniority date should be: August 7, 2009, as that is the date I entered Unit 4-3 at MCI Norfolk. My date must be calculated back to that date as disciplinary report No. #213260 was ORDERED VACATED by the Suffolk Superior Court (McIntyre, J.) on June 20, 2012, and after the DENIAL of the DOC's "Motion for relief from judgement" on August 24, 2012, the grievant must be returned to his prior "seniority date" as he is guilty of no offense or action which can be used to negatively impact that date. The grievant's true and accurate seniority date is August 7, 2009. (See Grievance Exhibit "B" - grievant's "Bed Management Sheet")

In the letter of Ms. Ryan (Grievance Exhibit "A") she also states that the grievant "entered the E-2 housing unit on June 3, 2012". This does not take into consideration the fact that the grievant was living in housing unit F-1 when he suffered a medical emergency on May 6, 2011. The grievant had entered housing unit F-1 on April 15, 2011, only after an administrative move by Captain John Parent on that date. The grievant was living on unit A-2 at that time, and had been housed in unit A-2 since the date of March 11, 2011. The grievant had been housed, without a d-report or incident, in a regular housing unit since the date of March 11, 2011. The grievant cannot be punished for medical emergencies or administrative moves for non-disciplinary reasons.

Remedy Requested: WHEREFORE, the grievant's seniority date must be recorded as August 7, 2009, and he needs to be immediately placed in a single cell occupancy cell in order to render moot the very real retaliation of Ms. Ryan.
