I am safely in receipt of your November 3, 2016 communication in which you notify the Parole Board I am "encouraged to contact the Board directly..." (See Attachment "A") In light of the fact that the Parole Board previously claimed they "did not receive..." my August 17, 2016 request I felt it prudent to send a copy of the request to you directly less the Parole Board claim to "not receive" it again. (See Attachment "B"). The information they failed to provide is highlighted on the request for your attention.

I have received the petition of Timothy J. Muise appealing the non-response of the Office of the Chairman of the Massachusetts Parole Board (Board) to an August 17, 2016 request for public records. G. L. c. 66 10(b); see also 950 C.M.R. 32.08(2).

Re: FORMAL PUBLIC RECORDS LAW REQUEST

Dear Chairman Treseler:

Please consider this my formal request for Public Records in the possession of your office. I make this formal request pursuant to G.L. c. 66, ss. 10, and in accordance with 950 CMR 32.00, et seq. The specific records I am requesting are as follows;

- A true and accurate copy of the "Annual Report" that the Parole Board is required to provide to the Commissioner of Correction pursuant to M.G.L. c. 27, ss. 5(g), and

- A true and accurate copy of the "Rules relative to its performance" which the Parole Board must produce pursuant to M.G.L. c. 27, ss. 5(e) & (f).

The accordance with regulation your office has ten (10) days in which to reply to my formal request for Public Records. The Supervisor of Records also encourages the waiver of any fees for such records when they benefit the public interest as these requested records do.

Thank you for your time and anticipated prompt attention. I will be very anxiously awaiting the provision of the requested Public Records.
