Thank you for sharing Hector Santiago's story and your work as a prisoner rights activist. Mr. Santiago's letter was very insightful and provided a valuable account of the flaws within the parole system. As you mentioned, it is important to remember that those serving sentences are not merely statistics but members of the community as a whole. First person accounts, like the one you shared, solidify this point.

I commend you for your activism and look forward to our next visit with the Lifers' Group.

Dear Tim,

Today, I am in receipt of your letter dated September 21, 2016. You might say this is one of my quickest reply to one of your letters. Actually, I had intended to write to you before I would receive your letter. But you are quicker than I am.

Please, you and the others who were to be involved in the meeting on the 20th accept my regrets for missing your meeting. The problem was in several parts: My son Ben was coming with me; my staff scheduling went array due to illness, etc., and an issue that I failed to include in my planning the trip to Norfolk, was that of the automobile traffic related to the "Big E Exposition." After waiting for my son to end his work schedule, we headed for the Mass Pike, got caught in the traffic, and forty-five minutes later we had not yet reached the entry to the Pike.

Long story short, it would have been 6PM before reaching the Mass Pike where the traffic was still very heavy. So unfortunately, my planning was poor yet, please be assured that I will plan to visit with the Lifers Group the third Tuesday in October. However, because of his work schedule I might not be able to bring my son on a Tuesday.

I write to apologize for my absence at the October 18th Lifer's Group, INC meeting. My office was contacted by the DOC and we were informed that due to a situation with staffing illness at the prison they would not be able to accommodate my arrival.

I was disappointed by this turn of events but I will seek to rectify it as soon as possible. When this rescheduling is completed I will write you again to ensure that we can continue our meaningful and important discussions.

Dear Timothy,

Thanks for your letter and apologies for the delay in replying.

I sent the information you sent me about the gofundme page to the ITMS Board looking for suggestions on ways to get this information out to members. The next ITMS newsletter is not until the Fall and there isn't anything due to go out to members before that.

The best option seems to be to make this information available to members at the biennial conference which takes place June 15th - 18th. Many of those present will of course remember John and the work he did, and his son and his wife will be there too. I've no idea what response this will get but, as I said, it seems to be the best option.

To whom it may concern:

On June 16, 2016, a classification board recommended that Inmate Timothy Muise should "remain at MCI-Norfolk despite PBS of 3 utilizing a discretionary override code P" because at that time he had an open disciplinary report. Pursuant to 103 CMR 420.09(2), a further reclassification was scheduled for December 16, 2016.

I am representing Mr. Muise in connection with the disciplinary charge against him. The hearing on the disciplinary report was commenced on November 17, 2016 at MCI-Norfolk, but, through no fault of the inmate, it became necessary to suspend the hearing because certain evidence we had requested was not available that day. No date has been set for the continuation of the hearing. As a result, the disciplinary proceeding remains open at this time.

Given the circumstances, the Board should not utilize a Code P override based on the pending disciplinary report. Such an override is discretionary. It is not required and would, in any event, be inappropriate. The stated purpose of the Department of Correction classification system is "to promote public safety and the responsible reintegration of offenders." Mr. Muise is scheduled to be released on August 25, 2016. If the Board were to exercise a Code P override, consideration of a transfer to a lower security status could be deferred for another six months, making it unlikely that he would have meaningful access to the transitional programming that would provide for an orderly and effective re-entry to the community. This would not be consistent with the goal of responsible reintegration. Mr. Muise has been in prison for 18 years. Under the best of circumstances, the transition from prison life will not be easy for him. It is not only in his interest that he be given the opportunity to prepare for that transition. It is in the public's interest as well.

While I appreciate that there may be reasons for the various override provisions, a discretionary override should not be employed where it conflicts with the Department's stated policy and, indeed, with its fundamental obligation to protect public safety.
